APTA has posted a comprehensive summary and a highlights document that outline the Centers for Medicare and Medicaid Services' proposal for the coordination of care for Medicare beneficiaries through Accountable Care Organizations (ACO).
Of particular interest to physical therapists is a summary of a notice seeking input regarding the possible waivers of the application of the physician self-referral law, the federal anti-kickback statute, and certain civil monetary penalties per provisions to specified financial arrangements involving ACOs under the Medicare Shared Savings Program (MSSP).
Also available is a summary of the Federal Trade Commission's proposed statement of an antitrust enforcement policy that aims to ensure that newly formed ACOs do not result in reduced competition and higher prices for consumers. A fifth document details the possible application of the provisions of the Internal Revenue Code governing tax-exempt organizations to qualifying health care organizations participating in MSSP.
