Description: On January 24, 2013, the US District Court certified the final settlement of a 2-year legal battle to uphold the right of Medicare beneficiaries to receive reasonable and necessary care to maintain their condition or to prevent decline.
This landmark decision has triggered a firestorm of dialogue in the therapy community regarding the difference between skilled interventions and maintenance care. The injunctive provisions of the final settlement will be implemented by the Centers for Medicare and Medicaid Services within the year.
